If you are convicted of a DWI/DUI offense in New Jersey you may find yourself asking the same question. An ignition interlock device is a device containing a small breathalyzer which requires the operator of an automobile to blow into it prior to starting the car. If the device reads a breath alcohol higher than .005, the car will not start. Recently an additional penalty was added to the New Jersey DWI/DUI sentencing guidelines requiring the imposition of an ignition interlock device in certain situations. Specifically an interlock device may be required when:
- First DUI offense: Installation of interlock device for six months to one year upon restoration (Judge's Discretion); BAC 0.15% or greater or a refusal conviction requires mandatory installation of ignition interlock device during license suspension and for 6 months to 1 year following restoration
- Second Dui and refusal offenses: Mandatory installation of interlock device during license suspension and for 1 to 3 years following restoration
• Third DUI offense: Mandatory installation of interlock device during license suspension and for 1 to 3 years following restoration

If the court sentences you to get an interlock device, you will receive a notice of suspension from the MVC with instructions on how to obtain the device. In addition, failure to have an ignition interlock installed when ordered by a judge could result in an additional one year driving privilege suspension.
